Disney and Deadmau5 settle trademark dispute

After a protracted legal battle lasting nine months and featuring intermittent Twitter exchanges, Deadmau5, the renowned electronic music artist (Joel Zimmerman), and entertainment behemoth Disney have finally resolved their trademark dispute. The contentious issue revolved around Deadmau5’s distinctive mouse head logo, a prominent feature in his album artwork and live performances, bearing a resemblance to Mickey Mouse’s iconic silhouette. While Deadmau5 had already secured the trademark in over 30 countries, he faced opposition when attempting to register it in the US.

Disney objected to Deadmau5’s trademark application, asserting that his design was “nearly identical in appearance, connotation, and overall commercial impression” to Disney’s Mouse Ears Marks, leading to a legal dispute. The conflict spilled onto social media, with Deadmau5 expressing his grievances on Twitter and through the US Trademark Office, filing a cease and desist order regarding Disney’s use of his track “Ghosts ‘n’ Stuff” in a video remix featuring Mickey Mouse.

In a detailed rebuttal spanning thousands of pages, Deadmau5 disclosed past discussions with Disney about potential collaborations, including reinterpreting Fantasia for its 75th anniversary and remixing the Star Wars theme for the Disney XD series Star Wars Rebel. Despite these discussions, Disney remained steadfast in opposing the trademark, asserting that its concerns were not solely about Deadmau5’s costume but also about potential licensing of a wide array of merchandise.

The recently announced settlement brings an end to the legal wrangling, but the exact terms remain undisclosed. Details of the agreement are expected to become public upon official registration with the trademark office. Deadmau5, responding to inquiries on Twitter, refrained from divulging specifics, likely bound by legal constraints surrounding the settlement.
